A. Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed by consumers and businesses through the online shop of The Remaining Ember.

Consumers within the meaning of these Terms and Conditions are natural persons who enter into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional in nature.

3. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By clicking the order button, you submit a binding offer to purchase the goods contained in the shopping cart. The contract is concluded once we accept the order, in particular by sending an order confirmation or by dispatching the goods.

4. Prices

All product prices and payments are in euros. No Austrian VAT is added under the Austrian small-business rule (§ 6 Abs. 1 Z 27 UStG). For deliveries to Great Britain, UK VAT is added at checkout where the consignment's intrinsic value is £135 or less. For consignments above £135, import VAT, customs duty, and carrier handling fees may instead be payable by the recipient as described below.

Any additional shipping costs are clearly displayed in the shopping cart and before the order is completed.

5. Payment

Product orders may be paid by credit or debit card through Stripe. PayPal is not accepted for product orders. Payment is due immediately upon placing the order.

6. Delivery

Delivery is made to the delivery address provided by you. The available delivery countries, shipping methods, shipping costs, and estimated delivery times are stated in the online shop.

If a product is unavailable, we will inform you as soon as possible.

7. Retention of Title

The goods remain our property until full payment has been received.

8. Warranty

The statutory warranty rights apply. For consumer purchases, we are responsible for a lack of conformity that existed when the goods were delivered and becomes apparent within the applicable statutory period. Depending on the statutory requirements, remedies may include repair or replacement and, where the legal conditions are met, a price reduction or termination of the contract. A commercial guarantee, if expressly offered for a product, does not restrict these statutory rights.

For consumer contracts concluded on or after 1 October 2026, if goods are restored to conformity through improvement under the statutory warranty, the warranty period is extended once by one year in accordance with § 10 Abs. 2a VGG.

9. Customer Service and Complaints

Questions, warranty notices, and complaints can be submitted by email to [email protected], by telephone at +43 681 20617419, or by post to the contractual-partner address above. We will examine complaints without undue delay and reply using the contact details supplied by the customer. There is no separately charged after-sales service.

10. Liability

We are liable in accordance with statutory law. Nothing in these Terms excludes or limits liability where it cannot legally be excluded or limited, including liability for personal injury and mandatory consumer rights.

11. Product Images and Natural Materials

Product images are used to represent the goods offered. For handmade products, natural materials, plants, resins, herbs, waxes, dyes, or similar materials, natural variations in color, shape, structure, scent, or appearance may occur.

12. Applicable Law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which consumers have their habitual residence remain unaffected.

13. Contract Language

The contract language is English. If content is also provided in other languages, this is for better understanding. In case of doubt, the English version shall prevail.

14. Electronic Ordering, Corrections and Contract Storage

The customer reviews the cart, enters and checks their contact and delivery information, continues to the secure card form, and receives a final highlighted review of the essential product characteristics, quantities, shipping, tax, and total immediately before using the “Order with obligation to pay” button. Cart quantities can be changed or removed in the cart. Customer details can be corrected in checkout; a change after payment preparation resets that preparation so the corrected order can be reviewed again.

We store the order-time contract text and information with the order. After acceptance, the customer receives the contract confirmation and incorporated information by email on a durable medium. The shop does not currently provide a customer account for later retrieval, so the customer should retain the email and its attachments.

15. Final Provisions

If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.

B. Withdrawal Information

1. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, have or has taken possession of the goods.

If you ordered several goods as part of one order and they are delivered separately, the period begins on the day on which you, or a third party designated by you who is not the carrier, take possession of the last good. If a good is delivered in several lots or pieces, the period begins when you or that designated third party take possession of the last lot or piece.

by means of a clear statement, for example by email or letter, of your decision to withdraw from this contract.

You can also exercise your right of withdrawal through our online withdrawal function. If you use this option, we will send you an acknowledgement by email without delay containing the information in your withdrawal and the date and time it was received.

To meet the withdrawal deadline, it is sufficient that you send the notification of exercising your right of withdrawal before the withdrawal period expires.

2. Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs, except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us, without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. Returns must be sent or handed over to Jesse Daniel Hotchkin, The Remaining Ember, Brunnhölzl 2, 4873 Frankenburg, Austria. The deadline is met if you send the goods before the fourteen-day period has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to inspect their condition, properties, and functioning.

3. Exclusion or Expiry of the Right of Withdrawal

We do not currently rely on a statutory withdrawal exclusion for the standard physical goods offered in the webshop. If a future product is subject to an exclusion, that exception will be stated clearly in the product offer and checkout before the order is submitted.

C. Shipping & Payment

1. Delivery Countries

We currently deliver to:

• Austria
• Great Britain (England, Scotland and Wales)

We do not currently deliver to Northern Ireland, the Isle of Man, Jersey, or Guernsey.

2. Shipping Costs

Shipping costs are displayed in the shopping cart and before the order is completed.

3. Delivery Times

The stated delivery times are estimates from Austria. Longer delivery times may occur, especially for islands, exclaves, remote regions, public holidays, high parcel volumes, or other delays in the shipping process.

No separate environmentally friendly delivery option is currently available. If one becomes available, it will be identified among the selectable shipping methods before the order is submitted.

Deliveries within Austria are made primarily with GLS and occasionally with Austrian Post. Deliveries to Great Britain are made with UPS.

For handmade products, pre-orders, or custom-made goods, longer processing times may apply. These will be stated with the respective product.

4. Payment Methods

The following payment method is accepted for product orders:

PayPal is not accepted for product orders. Separate voluntary-support offerings may display their own available payment method.

5. Customs and Duties

Deliveries within Austria do not involve customs formalities. Great Britain is outside the European Union, so customs formalities may apply. For consignments with an intrinsic goods value of £135 or less, we collect UK VAT at checkout. Above £135, UK VAT is not collected at checkout; import VAT, customs duty, carrier handling fees, or other import charges may be collected from the recipient by the carrier or competent authority. The checkout shows which treatment applies before payment.

Great Britain checkout is offered only to customers who are not purchasing as UK VAT-registered businesses. UK VAT-registered business purchases require separate reverse-charge handling and cannot be placed through the consumer checkout.

6. Transport Damage

If goods arrive damaged, please contact us as soon as possible with photos of the damaged goods and packaging. Your statutory rights remain unaffected.

Some candles include wax embellishments that may loosen or fall off while the candle burns. Keep the surrounding area clear and make sure the surface underneath is large enough to catch melting wax or detached wax pieces.
