1. Scope
These Terms and Conditions apply to all orders placed by consumers and businesses through the online shop of The Remaining Ember.
Consumers within the meaning of these Terms and Conditions are natural persons who enter into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional in nature.

3. Offer and Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By clicking the order button, you submit a binding offer to purchase the goods contained in the shopping cart. The contract is concluded once we accept the order, in particular by sending an order confirmation or by dispatching the goods.
4. Prices
All product prices are total prices in euros. VAT-exempt under the Austrian small-business rule (§ 6 Abs. 1 Z 27 UStG). No VAT will be added at checkout.
Any additional shipping costs are clearly displayed in the shopping cart and before the order is completed.
5. Payment
The available payment methods are shown during checkout. Unless otherwise stated, payment is due immediately upon placing the order.
6. Delivery
Delivery is made to the delivery address provided by you. The available delivery countries, shipping methods, shipping costs, and estimated delivery times are stated in the online shop.
If a product is unavailable, we will inform you as soon as possible.
7. Retention of Title
The goods remain our property until full payment has been received.
8. Warranty
The statutory warranty rights apply.
9. Liability
We are liable in accordance with the statutory provisions. In cases of slight negligence, we are liable only for the breach of essential contractual obligations, for personal injury, or where liability is mandatory by law.
10. Product Images and Natural Materials
Product images are used to represent the goods offered. For handmade products, natural materials, plants, resins, herbs, waxes, dyes, or similar materials, natural variations in color, shape, structure, scent, or appearance may occur.
11. Applicable Law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which consumers have their habitual residence remain unaffected.
12. Contract Language
The contract language is English. If content is also provided in other languages, this is for better understanding. In case of doubt, the English version shall prevail.
13. Final Provisions
If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.
B. Withdrawal Information
1. Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, have or has taken possession of the goods.

by means of a clear statement, for example by email or letter, of your decision to withdraw from this contract.
To meet the withdrawal deadline, it is sufficient that you send the notification of exercising your right of withdrawal before the withdrawal period expires.
2. Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs, except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us, without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.
For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired.
You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to inspect their condition, properties, and functioning.
3. Exclusion or Expiry of the Right of Withdrawal
The right of withdrawal does not apply, or may expire prematurely, where statutory exceptions apply. This may apply in particular to goods made to customer specifications, goods clearly tailored to personal needs, goods delivered sealed for reasons of health protection or hygiene and unsealed after delivery, as well as certain digital content or date-specific services.
If an exception applies to certain products or services, this will be indicated in the relevant offer or during the ordering process.
